Terms of Service

Effective May 19, 2026. These Terms of Service ("Terms") govern your access to and use of victorbonnaire.com (the "Site") and any purchase, sale, consignment, or service performed by Victor Bonnaire LLC ("Victor Bonnaire," "we," "us," or "our"). By using the Site or transacting with us, you agree to these Terms.

Eligibility

You must be at least 18 years old and able to form a binding contract under applicable law to use the Site or transact with us. If you are using the Site or transacting on behalf of a business, you represent that you are authorized to bind that business to these Terms.

Site use

We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Site for personal, non-commercial purposes. You agree not to:

  • Use the Site in a way that violates any law or these Terms.
  • Scrape, copy, reproduce, or use our images, descriptions, or other content for any commercial purpose without our prior written consent.
  • Reverse-engineer, probe, or attempt to interfere with the security or integrity of the Site.
  • Submit false, misleading, or fraudulent information through any form.
  • Use the Site to harass any person or to send unsolicited communications.

Product listings, pricing, and availability

Every watch is a one-of-one vintage piece. We do our best to describe and photograph each piece accurately, but minor color, lighting, and proportional variation between screens is normal. Inventory is real-time but not guaranteed; a piece is not yours until we confirm payment and acceptance.

Prices are listed in U.S. dollars and may change at any time without notice. We reserve the right to refuse, cancel, or limit any order, including in the event of pricing or description errors, suspected fraud, payment issues, or inventory unavailability, at any time before shipment, with a full refund of any amount charged.

Condition, authenticity, and "as-is" sales

Vintage watches are sold as-is in the condition described and photographed at the time of sale. As works of mid-20th-century mechanical engineering, vintage watches may show wear, patina, and the effects of age, may not keep time to modern standards, are not guaranteed water resistant regardless of original specifications, and may contain service replacement parts from prior owners.

We authenticate every watch we offer to the best of our professional judgment based on inspection, reference materials, and our experience as specialists in the era we cover. Authentication is an expert opinion, not a guarantee against future re-evaluation by another party. Where a watch is sold with original papers, those papers are part of the description and are included with the sale.

Orders, payment, and taxes

Placing an order is an offer to purchase. Your order is accepted only when we charge your payment method and confirm acceptance by email. Until that point, we may decline or modify the order.

We accept payment through our checkout provider (Shopify Payments) and, for higher-value pieces, by wire transfer on request. Sales tax is calculated at checkout based on applicable jurisdictions. International buyers are responsible for any duties, taxes, or customs fees assessed on arrival.

Shipping

We ship every watch fully insured and signature-required, with the carrier and service level selected based on the value of the piece and the destination. Most orders ship within one business day of payment clearing. Title and risk of loss pass to you on delivery.

Returns

We accept returns within 3 days of delivery, in the same condition the watch left our workshop, including all original packaging and accessories. A restocking fee may apply. Returns must be authorized in advance, please email us within the 3-day window. Full terms are in our shipping & return policy.

Service and restoration

We perform service, restoration, and related work on vintage watches by appointment and through our nationwide ship-in service. No work begins without your written approval of a quote. Estimated turnaround times are estimates only; vintage parts sourcing, complications, and condition surprises can extend timelines.

We are not responsible for pre-existing conditions, parts that fail despite professional service, or losses caused by carriers in transit (which are covered under the carrier's insurance). If a watch you ship in is not picked up or paid for within 90 days of our written notice that work is complete or a quote has been declined, we reserve the right to assess storage fees and ultimately to enforce any applicable mechanic's lien under Colorado law.

Sell, consign, and ship-in submissions

When you submit a watch for sale, consignment, or service, you represent and warrant that you are the lawful owner of the watch or are authorized to act on the owner's behalf, that the watch is free of liens and encumbrances, and that all information you provide is accurate to the best of your knowledge.

Consignment terms are governed by a separate written agreement that we will provide before any consignment listing goes live. Until that agreement is signed, no listing, valuation, or sale commitment exists.

Reviews and submissions

If you submit a review, photo, comment, or other content to us or through any third-party review platform we use, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, display, and distribute that content in connection with marketing our business. Do not submit content that infringes any third party's rights or that is false or defamatory.

Intellectual property

All content on the Site, including photographs, text, logos, layouts, and the "Victor Bonnaire" name, is owned by or licensed to Victor Bonnaire LLC and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any of it without our prior written consent. Brand names and references (such as Rolex, Omega, Heuer, etc.) are used solely to identify the watches we sell and service; we are not affiliated with, authorized by, or endorsed by any watch manufacturer.

Third-party services and links

The Site uses third-party services for checkout, hosting, email delivery, analytics, and reviews. The Site may also link to third-party websites. We are not responsible for the content, practices, or availability of any third-party service or site.

Disclaimers

Except as expressly stated in these Terms or in a separate written agreement signed by us, the Site, our services, and any watches we sell or service are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.

Vintage watches are mechanical devices that require ongoing care. We make no warranty that any watch will keep time within any specific tolerance, remain accurate over any specific period, or be suitable for any specific activity, including but not limited to water exposure or sports use.

Limitation of liability

To the maximum extent permitted by law, Victor Bonnaire LLC, its owners, employees, and contractors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site, any purchase or sale, any service or consignment, or any other interaction with us. Our total aggregate liability for any claim arising from or related to the foregoing is limited to the amount you actually paid us for the specific transaction giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless Victor Bonnaire LLC, its owners, employees, and contractors from any claim, loss, liability, or expense (including reasonable attorney's fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or your interaction with us will be brought exclusively in the state or federal courts located in Boulder County, Colorado, and you consent to the personal jurisdiction of those courts. You and we each waive any right to a jury trial in any such dispute, to the extent permitted by law.

Changes to these Terms

We may update these Terms from time to time. The "Effective" date above shows when they were last updated. Material changes will be brought to your attention by a notice on the Site. Your continued use of the Site or transacting with us after a change indicates acceptance of the updated Terms.

Miscellaneous

These Terms, together with our Privacy Policy, Shipping & Return Policy, and any written agreement signed by us, are the entire agreement between you and Victor Bonnaire LLC regarding the Site and any transaction with us. If any provision is held unenforceable, the remainder will remain in full force. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms; we may assign them in connection with a sale or transfer of our business.
